株式会社佐川工務店が注文者から元請として請け負った広島県廿日市市における店舗改修工事において、令和５年８月１０日に労働者１名が、屋根のポリカーボネイトの明り取り部分を踏み抜き、２階床面まで転落し負傷する事故が発生した。 この件について、労働者に屋根の上で作業を行わせるに当たり、踏み抜きによって労働者に危険を及ぼすおそれのある場所であったにも関わらず、同屋根上に歩み板を設け、防網を張る等、当該危険を防止するための必要な措置を講じなかったとして、令和７年２月２７日、広島簡易裁判所より同社と同社会長１名が労働安全衛生法違反で略式命令（いずれも罰金１０万円）を受け、その刑が確定している。 このことが、建設業法第２８条第１項第３号に該当すると認められる。
