令和元年９月19日、株式会社小関工務店の敷地内において、同社の労働者がフォークリフトを使用して作業していた際に、崩れた荷の下敷きになり死亡する災害が発生した。同社の代表取締役は、法定の資格を有しない労働者を、フォークリフトの運転業務に就かせた。 以上のことが、労働安全衛生法第61条第1項、第119条第１号、第122条及び安全衛生施行令(昭和47年政令318号)第20条第11号に違反し、株式会社小関工務店及び同社取締役が罰金刑に処せられた。 このことが、法第28条第１項第３号に該当する。
