Additionally, during the same period and at these offices, the respondent had persons without qualification forge real estate agent licenses to sign contractual documents related to 351 building lease mediations, in violation of Article 37 of the Act. Furthermore, from June 1, 2022, to February 14, 2024, at these offices, the respondent failed to appoint a dedicated licensed real estate agent as required by Article 31-3, Paragraph 1 of the Act, resulting in a violation of the same provision, and did not take necessary measures within two weeks to rectify this situation. These actions violate the provisions of Article 31-3, Paragraph 3, Article 35, Paragraph 1, and Article 37, Paragraph 3, of the Act.

被処分者は、令和４年４月１５日から令和６年２月１４日の間における合計２８８件の建物の賃貸借の媒介に関して、従たる事務所である藤井寺店、鉢中野店及び松原店において、宅地建物取引士証を偽造していた資格のない者に、法第３５条の規定に基づく重要事項の説明を宅地建物取引士として行わせた。 また、上記期間及び事務所において、合計３５１件の建物の賃貸借の媒介に関して、宅地建物取引士証を偽造していた資格のない者に、法第３７条の規定に基づき交付される契約関係書面について、宅地建物取引士として記名をさせた。 さらに、令和４年６月１日から令和６年２月１４日の期間に、上記事務所において、法第３１条の３第１項に規定する専任の宅地建物取引士を置かない状態が発生し、同項の規定に抵触するに至ったにもかかわらず、２週間以内に同項の規定に適合させるための必要な措置を執らなかった。 以上の行為は、法第３１条の３第３項、法第３５条第１項及び法第３７条第３項の規定に違反する。
