桑原重機株式会社は、同社の業務に関し、令和４年１２月１２日、富士吉田市の本社工場において、同社の労働者が、ベルトコンベアーの点検作業中に、当該コンベヤーのベルトとプーリーの間に左腕を巻き込まれ、左上腕を肩部から切断するという労働災害が発生した。当該ベルト及びプーリーは、労働者に危険を及ぼすおそれがある部分であったにもかかわらず、覆いを設けるなどの危険を防止する措置を講じなかった。 このことにより、同社及び同社の専務取締役は、令和６年１月３０日、労働安全衛生法違反により富士吉田簡易裁判所から各々罰金２０万円の略式命令を受け、その刑が確定している。 このことは、建設業法第２８条第１項第３号に該当すると認められる。
