当該建設業者は、大阪市内の民間発注工事（以下「本件工事」という。）において、建設業法第３条第１項の規定に違反して建具工事業に係る同項の許可を受けないで建設業を営む株式会社ティーキューブと下請契約を締結した。 また、本件工事において、株式会社ティーキューブは当該建設業者に対する現場作業に係る実地の技術指導、元請負人との協議、貴社からの協議事項への判断・対応などを主として行わないなど自ら施工計画の作成、工程管理、品質管理、安全管理、技術的指導等を主として行わず請け負った建具工事の主たる部分を同社に請け負わせており、同社は、建設業法第22条第２項の規定に違反して、株式会社ティーキューブから同社の請け負った建設工事を一括して請け負った。
