１ 当該建設業者は、大阪市内の独立行政法人高齢・障害・求職者雇用支援機構発注の工事（以下「本件工事」という。）において、建設業法第22条第１項の規定に違反して、その請け負った建設工事を一括して辻󠄀原総業株式会社に請け負わせた。 ２ 当該建設業者は、本件工事において、辻󠄀原総業株式会社に解体工事一式を請け負わせる下請契約を締結し、その旨を発注者に提出したところ、発注者より一括下請負の疑義を指摘され翌月にA社が１次下請負人として仮設工事を担当する施工体系図（同社の主任技術者はB）を発注者に提出した。しかし、実際には、当該建設業者が解体工事一式を辻󠄀原総業株式会社に、杭工事を除く解体工事一式を同社が山本組株式会社に、仮設工事等を同社がA社の従業員が代表を務める建設業の許可を受けていないアスモテックに、仮設工事等を同社が建設業の許可を受けていない建勝仮設に請け負わせていた。また、A社の主任技術者と記載されたBは、同社の従業員ではなく、建勝仮設が雇い、又は下請契約を締結していた。このように、当該建設業者は、本件工事において、建設業法第24条の８第１項及び第４項の規定に違反して、虚偽の施工体制台帳及び施工体系図を作成した。
