令和３年10月22日、神奈川県横須賀市の工事現場において、当該工事現場における現場代理人が、労働者に車両系荷役運搬機械等である貨物自動車を用いて機械の輸送作業を行わせるにあたり、貨物事業者の運転席者が運転位置から離れるときは、原動機を止め、かつ、停止の状態を保持するためのブレーキを確実にかける等の貨物自動車の逸走防止措置を講じさせなければならないのに、これら措置を講じさせず、もって、機械、器具その他の設備による危険を防止するため必要な措置を講じさせなかったものである。 以上のことが、労働安全衛生法第20条第1項及び労働安全衛生法施行令(昭和47年政令318号)第151条の11第１項に違反し、株式会社四国開発及び現場代理人であった同社社員１名が罰金刑に処せられた。 このことが建設業法第28条第１項第３号に該当する。
