長田建設株式会社の代表取締役は、同社が請け負った奈良県香芝市内での解体工事の安全管理に関し、同工事現場の労働者に、要求性能墜落制止用器具を使用させる等の措置を講じなければならないにもかかわらず、その措置を講じず、もって労働者が墜落のおそれのある場所に係る危険を防止するための必要な措置を講じなかった。 このことにより同社代表取締役は、労働安全衛生法違反として罰金に処する旨の判決を受け、当該判決が確定した。 このことは、建設業法第２８条第１項第３号に該当すると認められる。
