被処分者は、令和4年3月に、売主Aと買主Bとの間の宅地のみの売買につき媒介業務を行った。この業務において、①本件宅地上に建築する建物の建築確認の前に、インターネット不動産情報サイトに、本件宅地及び当該建物の両方を対象物件として記載した「新築一戸建て」の売買の広告を掲載した。②宅地建物取引業法第35条に定める書面(重要事項説明書)の「手付金等の保全措置の概要」欄に、本件宅地が未完成物件である旨の誤った記載をした。③本件契約が成立し、B以外の相手方に対し本件宅地を売ることができなくなったにもかかわらず、その後、少なくとも5日間、当該広告の掲載を継続していた。これらのことは、①は、同法第33条に違反し、②及び③は、いずれも同法第65条第1項第2号に該当する。
