（株）海洋潜水が請け負った和歌山下津港海岸（海南地区）日方水門築造工事の現場において、令和４年４月１８日に作業員が負傷する事故を発生させた。令和４年４月２５日、同社は事故について自社敷地内の資材置き場で発生したものとして、虚偽の内容を記載した労働者死傷病報告書を和歌山労働基準監督署に提出した。 この件について、同社及び同社の代表取締役は、労働安全衛生法違反により、和歌山簡易裁判所からそれぞれ罰金刑の略式命令を受け、令和５年１２月２７日にその刑が確定している。 このことが、建設業法第２８条第１項第３号に該当すると認められる。
