当該建設業者は、大阪市発注の複数の工事において、建設業法第３条第１項の規定に違反して建築工事業又は鋼構造物工事業に係る同項の許可を受けないで建設業を営む恒栄建装と下請契約を締結し、そのうちの一つの工事において、同法第22条第１項の規定に違反して、その請け負った建設工事の主たる部分を一括して同者に請け負わせた。 また、当該建設業者は、大阪市発注の複数の工事において、建設業法第24条の８第１項又は第４項の規定に違反して、施工体制台帳若しくは施工体系図の作成を怠り、又は虚偽の施工体制台帳若しくは施工体系図を作成した。
