株式会社錢高組(以下、同社という。)が落札した近畿中部防衛局(以下、同局という。)発注の「岐阜(２)評価施設新設建築その他工事」において、同社の元名古屋支店長が、同局職員より調査基準価格に近い金額を事前に入手したことにより、公正な入札を妨害したとして、令和4年11月7日に刑法第96条の6第1項(公契約関係競売等妨害)違反並びに入札談合等関与行為の排除及び防止並びに職員による入札等の公正を害すべき行為の処罰に関する法律(官製談合防止法)第8条違反により懲役1年6ヵ月(執行猶予3年)の判決を受け、その刑が確定している。 このことが、建設業法第28条第1項第2号及び第3号に該当すると認められる。
