株式会社横内造園の代表取締役は、四国中央市内の個人宅において、令和６年４月10日、同社従業員が樹木の剪定作業中に墜落し負傷した事故に関し、同作業は地面からの高さが２メートル以上の箇所で行う作業で、墜落により労働者に危険を及ぼすおそれがあり、かつ、作業床を設けることが困難であったため、労働者に要求性能墜落制止用器具を使用させるなどの墜落による労働者の危険を防止するための措置を講じなければならなかったにもかかわらず、その措置を講じず、もって労働者が墜落するおそれのある場所に係る危険を防止するため必要な措置を講じていなかったとして、同年10月10日、労働安全衛生法違反の罪により四国中央簡易裁判所から罰金の略式命令を受け、その刑が確定している。 このことは、建設業法第28条第１項第３号に該当する。
