当該建設業者は、大阪市発注の工事において主任技術者として配置したAを、工期の重複する専任の技術者の配置を要する他の大阪市発注の工事において、建設業法第26条第３項の規定に違反して、専任を要さない主任技術者として工事現場に配置した。 また、当該建設業者は、建設業法第31条第１項の規定に違反して、大阪府知事に対し、大阪市発注の工事において、直接請け負わせていない他の建設業者の印影を貼り付けて偽造した虚偽の注文請書を提出して、同社と当該建設業者が直接契約をし直したとの虚偽の報告を行った。
