当該建設業者は、枚方市内の民間発注の工事（以下「本件工事」という。）において、発注者との間で、報酬がその工事代金を含む金額、建物完成後発注者にそれを引き渡してその賃料を保証する旨などを約束したコンサルタント業務委託契約を締結した。その後、発注者が本件工事の敷地を取得し、当該建設業者が当該建設業者の名義で他の建設業者と建設工事請負契約を締結し、完成した建物を直接又は当該建設業者を通じて発注者に引き渡した。 よって、本件工事にかかるコンサルタント業務委託契約は、報酬を得て建設工事の完成を目的として締結する契約であるため、建設業法第24条の規定により、建設工事の請負契約とみなされて同法の規定が適用される。 しかし、当該建設業者は、本件工事において、決算書等の工事完成高には計上していたものの、建設業法が適用されないと解釈して、同法第16条第１号の規定に違反して、同法第３条第１項第２号に掲げる区分による許可を受けないで、その下請代金の額が同号の政令で定める金額以上の下請契約を他の建設業者と締結した。また、同法第22条第１項の規定に違反して、その請け負った建設工事を一括して他の建設業者に請け負わせた。
