当該業者の従業員高田則幸氏は、当該業者が請け負った岩手県二戸市上斗米字立当151番地の牛舎新築工事の現場責任者として労働者を指揮監督及び労働者の安全管理を行うものであるが、同氏は、当該業者の業務に関し、令和３年５月13日、同工事現場において、労働者に梁の調整作業を行わせるに当たり、同作業場所は地上から約3.32メートルの高さに位置する桁上で、墜落により 労働者に危険を及ぼすおそれのある箇所であり、かつ、足場を設置する等の方法により作業床を設けることが困難ではなかったのに、これを設けないなど墜落による労働者の危険を防止するための措置を講じず、もって労働者が墜落するおそれのある場所に係る危険を防止するため必要な措置を講じなかったことにより、当該業者及び同氏が労働安全衛生法違反により罰金の略式命令を受け、その刑が確定している。 このことが、建設業法第28条第１項第３号に該当すると認められる。
