当該建設業者は大阪市に本店を置き、建設工事請負業を営む事業者であり、特定事業の仕事である大阪市所在の新築工事を自ら行う注文者、Aは当該建設業者の労働者であり、同工事の施工及び労働者の安全を管理するものであるが、Aは、当該建設業者の業務に関し、令和４年６月28日、同工事現場において、同工事の請負人である他の業者の労働者Bに、建設中の建物の破風板塗装作業を行わせるため 第１ 建物東面に仮設された一側足場の６段目の足場板を作業床として使用させるに当たり、同作業床は地上からの高さが約９メートルの箇所であり、墜落により労働者に危険を及ぼすおそれがあり、同作業床に囲い、手すり、覆い等を設けることが作業の性質上困難ではなかったのに、これを設けず、 第２ 建物東面に仮設された一側足場の６段目の足場板を作業床として使用させるに当たり、同作業床は地上からの高さが約９メートルの箇所であったのに、労働者が安全に昇降するための設備等を設けず、 第３ 建物東面に仮設された鋼管足場で一側足場の単管足場を使用させるに当たり、当該足場に垂直方向５メートル以下、水平方向５．５メートル以下の間隔により、壁つなぎ又は控えを設けず、厚生労働省令で定める足場の基準に適合しない足場を使用させ、もって、建設物等について、当該労働者の労働災害を防止するため必要な措置を講じなかったものである。 このことで、当該建設業者は労働安全衛生法（昭和47年法律第57号）違反により、罰金50万円の刑に処せられ、令和５年12月22日にその刑が確定した。
