令和３年１２月１４日から１２月１７日まで貴社に対して保安監査を実施したところであるが、監査の結果、下記のとおり改善を要する事項が認められたことから、改善措置を講ずるよう指示する。 なお、改善措置を講じるにあたっては、背後要因を含め当該事項が発生した原因を究明した上で、再発防止に必要な改善策を策定するとともに、法令に基づく検査等、輸送の安全に係る業務が確実に実施できるよう留意すること。 講じた措置については、令和４年５月９日までに報告されたい。 記 １．鉄道事業法に基づく鉄道施設及び鉄道車両の変更手続き関係 鉄道事業法に基づく鉄道施設及び鉄道車両の変更手続きに関して次の事実を認めたことから、早急に同法に基づく変更手続きを実施すること。 また、今後、同法に基づく各種手続きが確実に実施されるよう管理体制を確立すること。 ①鉄道事業法第１２条第１項及び第４項に基づく鉄道施設の変更手続きを行うことなく、まくらぎの材質及び構造寸法、レール締結装置の種類及び構造寸法並びにプラットホームの有効長及び高さを変更していた。 ②鉄道事業法第１２条第１項及び第２項に基づく鉄道施設の変更手続きを行うことなく、列車無線の種類、保安通信線の線種及び架設方法並びに黒沢踏切道保安設備の作用を変更していた。 ③鉄道事業法第１３条第２項に基づく車両構造装置の変更手続きを行うことなく、列車無線設備が変更された車両を事業の用に供していた。 ２．実施基準に基づく鉄道施設の保守管理関係 実施基準に基づく鉄道施設の保守管理に関して次の事実を認めたことから、早急に実施基準に基づき必要な措置を講じること。 また、鉄道施設の保守管理については、これまでも再三指導を行っているところではあるが、不適切な管理があったことから、これを重く受け止め、今後の鉄道施設の保守管理において、同様の事象が二度と発生しないよう関係者への法令等遵守の徹底、管理方法の見直しを含めた抜本的な措置を講じること。 ①運転保安設備実施基準第５４条第１項に規定する定期検査について、同実施基準別表信号通信設備検査方法（信号）に規定する電源装置乾電池の検査及び別表その他駅・構内設備検査方法に規定する照明電灯設備分電盤配電箱等屋内配線の絶縁抵抗検査を実施していなかった。 ②軌道・土木設備実施基準第５２条に規定する一般軌道及び分岐器の軌道狂い検査について、同実施基準第３８条及び第４３条に規定する整備基準値を超過している箇所が複数あったにもかかわらず、必要な措置を講じていなかった。 ③軌道・土木設備実施基準第５１条に規定する路盤検査について、同実施基準第５４条に規定する噴泥の状態が確認されたにもかかわらず、必要な措置を講じていなかった。 ④軌道・土木設備実施基準に規定する建造物の検査について、同実施基準第１８条に規定する建築限界を支障している箇所が複数あったにもかかわらず、必要な措置を講じていなかった。 ⑤運転保安設備実施基準に規定する閉そく装置の検査について、基準値が定められておらず、また、同実施基準第５７条に規定する設備の機能が正常な安定した状態を失うおそれがあると認められた場合であるにもかかわらず、必要な措置を講じていなかった。 ⑥次の公衆に影響を及ぼす不適切な鉄道施設について、必要な措置が講じられていなかった。 (1) 矢島駅構内の照明電灯設備コンクリート柱が著しく傾斜していた。 (2) 飯沢踏切道の遮断かん及び小板戸踏切道のクロスマークが退色していた。 (3) 黒沢駅構内の照明電灯設備木柱が倒壊し、電線が垂下していた。 ⑦運転保安設備実施基準に規定する検査記録について、同実施基準第５８条に規定する修理を行った際の検査結果（措置完了年月日及び成績）を記録していなかった。 【東北運輸局】
