久保興業株式会社は、愛媛県発注の（一）鳥首五十崎線道路改築工事の現場において、令和３年２月15日、同社従業員がバックホウのバケットと擁壁の間に挟まれて死亡した事故に関し、運転中のドラグ・ショベルに接触することにより労働者に危険が生ずるおそれがあったにもかかわらず、誘導者を配置せず、労働者をその作業範囲内に立ち入らせ、もって機械等による危険を防止するため必要な措置を講じなかったとして、同年11月１日、労働安全衛生法違反の罪により大洲簡易裁判所から罰金の略式命令を受け、その刑が確定している。 このことは、建設業法第28条第１項第３号に該当する。
