株式会社真重建は、大分市庄境1番44号シークハイツに本店を置いて建設業を営み、大分市大字中ノ洲２番地に所在する大分石油化学コンビナート構内で施行の2号ボイラー本体定期点検工事において、下請として足場の解体作業を行う事業者である。 同社の代表取締役は、労働災害に関する手続を行う者であるが、令和2年4月15日に同社の労働者が同工事において、足場材の受け渡しの作業の際に右第4・5中手骨骨折の負傷を負い、4日以上休業することになったのに、「被災地の場所」を大分市大字迫字新殿843とし、「災害発生状況及び原因」を同社の資材置き場で足場材をトラックに積み込んでいた際に負傷したとする虚偽の様式第23号労働者死傷病報告を作成して、同報告を令和2年7月28日に所轄である大分市新川町2丁目1番36号所在の大分労働基準監督署に提出し、もって同署長に虚偽の報告をしたとして、大分簡易裁判所から労働安全衛生法違反として法人及び代表取締役が罰金10万円の略式命令を受け刑が確定した。 このことは、建設業法第28条第1項第3号に該当する。
