株式会社柳沢建設の元役員は、鹿角市が令和2年5月19日に一般競争入札を執行した統合校舎(花輪第二中学校)大規模改造工事(機械設備工事)に関し、前鹿角市長から最低制限価格等の教示を受け、同社に同工事を落札させ、もって偽計を用いて公の入札で契約を締結するためのものの公正を害すべき行為をしたとして、公契約関係競売入札妨害の罪により、令和4年7月25日に秋田地方裁判所において元役員のうち一人は懲役1年(執行猶予3年)、他の一人は10月(執行猶予3年)の判決を受け、その刑が確定した。 このことが、建設業法第28条第1項第2号に該当する。
