株式会社伊藤鉄工所の代表取締役は、同社の業務全般を統括管理するとともに、労働者の安全を管理するものであるが、令和５年２月23日、神奈川県川崎市川崎区浮島町７－４において、電動ホイストを使用して地上から高さ約26.7メートルのサイロ上部に資材を吊り上げる作業を労働者に行わせるに当たり、同作業により吊り上げられた資材が落下し、労働者に危険を及ぼすおそれがあったのであるから、立入区域を設定する等の措置を講じなければならなかったのに、当該危険を防止するための措置を講じなかった。 その結果、令和６年２月９日に同社及び同社の代表取締役が川崎簡易裁判所から労働安全衛生法違反による罰金20万円の略式命令を受け、その刑が確定した。 このことは建設業法第28条第１項第３号に該当する。
