タチバナ工業株式会社の社員（当時取締役）は、令和３年１１月９日に香川県土庄町が入札を執行した架橋工事１件の競争入札に関し、高松市の建設会社の実質的経営者を介し、当時同町の町長であった者から秘密事項である最低制限価格の情報提供を受け、その情報を元に同社を代表者とする特定建設工事共同企業体が落札した。 これにより同社社員は、刑法第６０条及び第９６条の６第１項に該当し、令和４年６月１日に懲役１年６ヶ月（執行猶予３年）の判決を受け、その刑が確定した。 このことが、法第２８条第１項第３号に該当すると認められる。
