１ 請負契約の状況 当該建設業者は、大阪市内の民間発注の工事において、株式会社大林組から一次下請負人としてヒロセ株式会社が事務所棟無芯ソイル工事、山留・構台・支保工工事等を請け負い、同社から当該建設業者がSMW工法工事、支持杭打設工事等を請け負った。 ２ 工事現場の状況 当該工事現場は、約２度の傾斜がある登坂に盛られた地面上に敷鉄板が置かれ、その上に当該建設業者の大型杭打機（６号機）（重量 28t/㎡）が配置されていた。当該建設業者は、注文者であるヒロセ株式会社にはこの勾配を水平にするよう依頼していたが、水平には改善されなかった。当該建設業者は、令和６年11月１日（金）に、当該杭打機で、地盤改良材を打設する工事を施工した。令和６年11月２日（土）、当該工事現場に、14時頃の１時間に約40ｍｍの降雨があった。 なお、表層部の地盤改良は、ヒロセ株式会社等からの指示により、埋め戻し土に地盤改良材（セメント、粘土鉱物及び水）を配合する施工方法を採用しており、良質土等による置換は行われていなかった。 ３ 事故の状況 当該建設業者は、令和６年11月５日（火）、午前９時35分頃、同月２日の降雨から１日以上経過しているため地盤が固くなっていると思い込み、地盤の強度を確認せず、誘導員による誘導の前に、２の配置された杭打機を２のとおり同月１日に地盤改良した直上を進行しようと移動した直後に、埋め戻しに使用した残土（地盤改良材（セメント、粘土鉱物及び水）を配合したもの。元請負人である株式会社大林組は降雨により乱され地盤表面の雨水の流れによって一部が流されたと推察している。）が水分を吸収していて（転倒当日のキャタピラ周辺には水たまりと押し出された残土が見られた。）、実際には当該地盤の耐力が約8t/㎡であっため、埋め戻し残土に接する地山が登坂してきた杭打機の重量に耐え切れず埋め戻し残土側に崩壊し、当該崩壊地点を転倒支点として、杭打機が前方に転倒し、市道を塞ぎ、市道の向かいの美術館の屋根を損傷し、電線を巻き込んで電柱も転倒させて一時周辺に停電（約20件３時間）を発生させ、通行人が転倒するなどの被害を生じさせた。 ４ 以上のとおり、当該建設業者は、建設業者として大型杭打機の転倒による危険を防止するために、大雨等が降った後や山留工事を施工した後等、地盤の状況の変化後に工事を再開して重機を移動させる際には、地盤の強度等を確認すべきところ、これを怠るなど、令和６年11月５日、３のとおり、建設工事を適切に施工しなかったために公衆に危害を及ぼした。
