対象業者は、一次下請として請け負った秋田県内の設備解体工事現場において、令和４年５月２７日に自社の労働者が脚立から転落し、右足踵を骨折したにもかかわらず、元請負人の求めに応じ、自社の倉庫内で負傷した旨の虚偽の内容を記載した労働者死傷病報告を大館労働基準監督署に提出した。 この件について、対象業者及び関与した社員が、令和７年６月６日付けで大館簡易裁判所から労働安全衛生法違反により罰金刑の略式命令を受け、その刑が確定している。 このことが、建設業法第２８条第１項第３号に該当すると認められる。
