当該建設業者は、大阪市内の民間発注の工事において、建設業者として杭打機の転倒による危険を防止するために多目的アースドリル機の配置、使用部材の運搬に関する作業計画をあらかじめ定め、当該杭打機の最大使用荷重を守るなどの措置を講じるべきところ、それを怠り、多目的アースドリル機が転倒したことにより電線に引っ掛かり、電柱が倒れたことで現場周辺の建築物を損傷し、また、電線が切れ、最大でおよそ720戸において停電するなど、建設工事を適切に施工しなかったために公衆に危害を及ぼした。
