令和２年８月３１日、新潟県新潟市東区下山３丁目６８０番地所在の新潟浄化センターNo.1浮上濃縮機修繕工事において、株式会社成秀工業の従業員である同工事の現場責任者は、法定の除外事由なく、同工事において労働者をして、引火性の危険物をNo.1浮上濃縮機内において吹き付け、機械に付着したグリスの除去を行わせた後、同濃縮機内において、労働者をして点火源となるおそれのあるバーナーを使用させ、もって危険物による危険を防止するため必要な措置を講じなかった。本件に係る労働災害により、当該濃縮機内にいた当該会社の労働者３名及び当該会社の下請業者に所属する労働者１名が熱傷を負った。これにより、群馬富岡簡易裁判所から労働安全衛生法第２０条第２号、同法第２７条第１項、労働安全衛生規則第２７９条第１項違反のため、当該会社及び当該現場責任者に対し、罰金各２０万円の判決が出され、令和３年９月２２日にその刑が確定した。このことが建設業法第２８条第１項第３号に該当する。
