1 A氏は、平成28年から令和４年まで、他の建設業者等に雇われて工事現場の管理に従事しており、当該建設業者と雇用契約を締結したことも無かった。また、当該建設業者から給与を受領したこともなく、給与の額が最低賃金法（昭和34年法律第137号）に基づく大阪府の地域別最低賃金以上となりえる者でもなかった。 ２ 当該建設業者は、令和元年11月18日に提出した建設業法第５条の許可申請書及び同法第６条第１項の書類に、１のとおり、A氏が専任の者ではなく、営業所に置いている者でもなかったにもかかわらず、A氏を同法第７条第２号に規定する専任の技術者として同社の営業所に置いているとの虚偽の内容を記載し、同年12月13日に内装仕上工事業に係る同法第３条第１項の一般建設業の許可を受けた。 ３ A氏が令和３年10月には他の建設業者に所属していることを証する監理技術者資格者証の交付を受けるなど、１のとおり、他の建設業者等に雇われていた。また、A氏が令和２年４月以後当該建設業者の営業所の所在地から遠距離にあり、通勤不可能となる大阪府外へ転居し、令和４年９月には他の建設業者の常勤の役員に就任していた。これらのため、当該建設業者は、建設業法第７条第２号に掲げる許可の基準を満たしていなかった。
