株式会社富田建設は、新潟地域振興局津川地区振興事務所が発注した新潟県東蒲原郡阿賀町七名地内の復旧治山復第３号復旧治山工事における元請負人である。 当該工事において、令和５年７月28日に一次下請会社の労働者が車両転倒事故により１名死亡する事案が発生した。同工事の施工管理及び安全管理を統括していた現場責任者である(株)富田建設の従業員は、現場の整地作業を行わせるに当たり、建設機械車両の転倒により労働者に危険が生ずるおそれがあったのに、車両誘導のための誘導者を配置せず、危険を防止するための必要な措置を講じなかった。 このことから、法人及び同社現場責任者が、労働安全衛生法違反により罰金刑（法人20万円、同社現場責任者20万円）に処され、令和６年４月26日にその刑が確定している。 このことが、建設業法第28条第１項第３号に該当する。
