株式会社水機テクノスは、建設業法第２６条の規定に違反して、資格要件を満たさない者を監理技術者として工事現場に配置していた。 また、経営事項審査において、資格要件を満たさない者を技術職員名簿に記載し虚偽の申請を行うことにより得た経営事項審査結果を公共工事の発注者に提出し、公共発注者がその結果を資格審査に用いた。 これらのことが、建設業法第２８条第１項第２号に該当すると認められる。
