１ 当該建設業者は、令和２年５月21日に提出した建設業法第５条の許可申請書及び同法第６条の書類（以下「令和２年許可申請書類」という。）において、同月２日に撮影した大東市大野一丁目10番１号１階に所在する事務所及びその机、電話機等の写真を貼付した「営業所概要書」（電話番号 072-xxx-xxxx 固定電話と記載）を添付していたが、「072-xxx-xxxx」は実際には他社の事務所内に設置された電話に係るもので「営業所概要書」等に表示された事務所には固定電話の回線は設置されていなかった。 ２ 当該建設業者は、令和２年許可申請書類において、「経営業務の管理責任者証明書」、「経営業務の管理責任者の略歴書」及び「役員等の一覧表」に常勤の役員ではないＡ氏を常勤の役員であると記載し、Ｂ建築設計事務所に勤務していたにもかわらず「経営業務の管理責任者の略歴書」にその事実を記載せず、同略歴書に記載のある「Ａ事務所」とは建設業の営業に係るものではなく、これらのため、同人は建設業法第７条第１号イの「許可を受けようとする建設業に関し５年以上経営業務の管理責任者としての経験を有する者」ではないにもかかわらず、「経営業務の管理責任者証明書」に同人がその経験を有する者であるなどと記載した。 ３ 当該建設業者は、令和２年許可申請書類において、建設業法第７条第２号の「専任のもの」とは営業所に常勤して専ら職務に従事することを要する者をいい、雇用契約等により当該建設業者と継続的な関係を有し、休日その他勤務を要しない日を除き、通常の勤務時間中はその営業所に勤務し得るものでなければならないところ、そのような「専任のもの」ではないＣ氏を同法第７号第２号に規定する専任の技術者として置いている旨を記載した。 ４ 当該建設業者は、建設業法第７条第１号の規定に基づく経営業務の管理責任者であるＡ氏が当該建設業者の常勤の役員として職務に従事しておらず、同条第２号の「専任のもの」であるＣ氏が当該建設業者の営業所に常勤して専ら職務に従事しておらず、同条第１号及び第２号に掲げる許可の基準を満たさなくなった。 ５ 当該建設業者は、令和２年許可申請書類（添付書類も含む。）において、１から３までのとおり、虚偽の内容を記載し、令和２年７月17日に、建設業法第３条第１項の建設業の許可を受けた。
