1. The construction company violated Article 16, Item 1 of the Building Business Act by contracting with Nihon Ecology Co., Ltd., a non-licensed construction business, for private construction projects in Shimonoseki City, Yamaguchi Prefecture, exceeding the amount specified in Cabinet Order under Article 3, Paragraph 1, Item 2 of the Act. 2. １ 当該建設業者は、山口県下関市内の民間発注の工事（以下「本件工事」という。）において、建設業法第16条第１号の規定に違反して、発注者から直接その工事を請け負った特定建設業者以外の建設業を営む者である株式会社日本エコロジーと下請代金の額が同法第３条第１項第２号の政令で定める金額以上となる下請契約を締結した。 ２ 当該建設業者は、山口県下関市内の民間発注の工事（工事場所：本件工事と同一）において、当初は土地の造成工事のみを請け負っていたものの、令和５年11月頃から、太陽光発電設備の設置などの電気工事を請け負って施工して請負代金５千万円を領収するなど、建設業法第３条第１項の規定に違反して、電気工事業に係る同項の許可を受けないで請負代金が建設業法施行令第１条の２に定める金額以上となる建設工事（電気工事）を株式会社日本エコロジーから請け負った。 ３ 本件工事（２の建設工事を含む。）において、株式会社日本エコロジーが監理技術者を配置しないなど適格な技術者を配置せず、同社が施工計画の作成、工程管理、品質管理、安全管理、技術的指導等の全てを行うことが必要であるところ、その全ては行わずにその請け負った建設工事の主たる部分を一括して当該建設業者に請け負わせており、当該建設業者は、建設業法第22条第２項の規定に違反して、株式会社日本エコロジーから同社の請け負った建設工事を一括して請け負った。
