株式会社蛭間興業代表取締役が、法定の除外事由がないのに、平成３０年１１月４日午前７時３０分頃から同日午後零時５分頃までの間、同社敷地内において、廃棄物である木くず等約０．１１８３立方メートルを焼却したものである。 当該事実に基づき、千葉簡易裁判所から平成３１年４月３日付け平成３１年（い）第３０２３８号略式命令において、廃棄物の処理及び清掃に関する法律違反により、法人が罰金５０万円、代表取締役が罰金３０万円の刑に処せられた。 このことが、法第２８条第１項第３号及び同条第３項に該当すると認められる。
