Consequently, Imai Komuten and A each received a summary order of a 300,000 yen fine for violations of the Industrial Safety and Health Act, and the penalties were finalized. 株式会社今井工務店は、Ｄ建設会社から請け負った令和２年度防災・安全交付金（火山砂防）（緊急対策事業）工事を施工する事業者である。Ａは、株式会社今井工務店の常務取締役として、同工事を含む安全管理を行う者である。令和３年６月24日、Ａは、同社の業務に関し、労働者Ｂに、車両系建設機械であるクレーン機能付きドラグ・ショベルを用い、法定の除外理由がないにもかかわらず、同機械の主たる用途ではない伐採木を移動する作業を行わせた。 機械等による危険を防止するために必要な措置を講じなかった結果、労働者Ｂがドラグ・ショベルを用いて、長さの異なる伐採木を３本つり上げ、旋回したところ、３本のうち短い２本が玉掛用ワイヤーロープからすり抜けて落下し、このうち１本（推定重量約１ｔ）が地面で跳ね返り、付近の労働者Ｃに激突し死亡するという災害が発生した。 このことにより、株式会社今井工務店及び常務取締役Ａは労働安全衛生法違反により各々罰金30万円の略式命令を受け、その刑が確定した。 このことは、建設業法第28条第１項第３号に該当する。
