山本組（株）は、独立行政法人高齢・障害・求職者雇用支援機構発注の「雇用促進住宅大阪桜島宿舎取壊し工事」において、アスモテック株式会社と下請契約を締結したが、当該下請契約について、貴社は、その請け負った建設工事を他の建設業を営む者に請け負わせたにもかかわらず、建設業法第２４条の８第２項の規定に違反して、元請業者に再下請負の通知を行わなかった。 このことは、同法第２８条第１項本文に該当すると認められる。
