四国化工機㈱は、建設業法第３条第１項の規定に違反して同項の許可を受けないで建設業を営む者と軽微ではない工事について下請契約を繰り返し締結した。 また、そのうち１件の工事において同法第16条第１項の規定に違反して、同法第３条第１項第２号に掲げる区分による許可を受けないで下請代金の額が建設業法施行令第２条に規定する金額以上となる下請契約を締結した。 さらに、同法第26条第２項の規定に違反して、当該工事現場において監理技術者を設置しなかった。 このことが、建設業法第28条第３項に該当する。
