（株）奥浜組は、令和６年２月14日の宮古島市における建築工事現場において、「請負人の労働者に、わく組足場における高さ２メートル以上の作業場所を使用させるに当たり、墜落により危険を及ぼすおそれのある箇所には、交さ筋かい（すじかい）及び高さ１５センチメートル以上４０センチメートル以下の桟（さん）若しくは高さ１５センチメートル以上の幅木（はばき）又はこれらと同等以上の機能を有する設備を設けなければならないのにこれを講じなかった」として、労働安全衛生法違反により令和７年１月７日、平良簡易裁判所より、罰金20万円（法人）、及び罰金20万円（法人役員）の略式命令を受け、その刑が確定している。 このことが、法第28条第１項第３号に該当すると認められる。
