株式会社深沢組（令和３年２月２６日に株式会社深沢に商号変更）の元代表取締役は、前橋市が令和２年６月２６日に執行した「農山漁村地域整備交付金農業集落排水事業（機能強化）込皆戸処理施設脱水機棟建築工事」に係る指名競争入札に関し、同市元職員から同入札に関する秘密事項である同工事の予定価格の教示を受け、同社に同予定価格に近接する金額で入札させて同案件を落札させ、もって偽計を用いて、公の入札で契約を締結するためのものの公正を害すべき行為を行った。 また、当該元代表取締役は、前橋市が令和２年７月８日に執行した「社資交（狭あい）道路改良工事（道建第１号）」に係る指名競争入札に関し、当該元職員から同入札に関する秘密事項である同工事の予定価格の教示を受け、当該会社に同予定価格に近接する金額で入札させて同案件を落札させ、もって偽計を用いて、公の入札で契約を締結するためのものの公正を害すべき行為を行った。 これにより、当該元代表取締役は、前橋地方裁判所から令和３年９月１６日に懲役１年(執行猶予３年)の判決を受け、同年１０月１日にその刑が確定した。 このことが、建設業法第２８条第１項第２号及び第３号に該当し、同条第３項に基づき営業停止処分とする。
