新日本特機株式会社は、電気工事業に係る営業所の専任技術者が令和２年９月30日に退社し、令和４年３月11日に新たな営業所の専任技術者が必要な資格を取得するまでの間、建設業法第15条第２号の基準を満たさなくなったことにより許可要件を欠いたまま営業していた。また、建設業法第15条第２号の基準を満たさなくなった場合、２週間以内に同法第11条第５項（同法第17条により準用。以下同じ。）に規定する届出書を知事に提出しなければならないにもかかわらず、令和４年５月27日に至るまで届出を行わなかった。 このことが、建設業法第15条第２号及び同法第11条第５項に違反し、同法第28条第１項本文に該当するものと認められる。
