株式会社エス・ディー・ディーの社員は、同社の業務に関し、富士宮市内の建柱工事現場において、移動式クレーンを用いて既設の電柱の引抜作業を行うに当たり、移動式クレーンの転倒等による労働者の危険を防止するため、あらかじめ、当該作業に係る場所の広さ、地形及び地質の状態、運搬しようとする荷の重量並びに使用する移動式クレーンの種類及び能力等を考慮して、移動式クレーンによる作業の方法、移動式クレーンの転倒を防止するための方法並びに移動式クレーンによる作業に係る労働者の配置及び指揮の系統を定めなければならないのに、これを定めずに当該作業を行い、もって機械等による危険を防止するため必要な措置を講じなかった。 この件について、富士簡易裁判所は令和５年12月27日に同社に対し、労働安全衛生法違反に基づき罰金20万円の略式命令を行い、これが確定した。 このことは建設業法第28条第１項第３号に該当するものと認められる。
