当該建設業者は、東京都港区内の民間発注の工事で、その請け負った建設工事を一括して株式会社匠屋に請け負わせた。同社は、本件工事において、Ｂ社等に解体撤去及び仮設工事を、Ｃ社等に防水工事を、Ｄ社等に造作工事を、Ｅ社等にＬＧＳ及びプラスターボード工事を、Ｆ者等に石及びタイル貼工事を、Ｇ社等に内装仕上工事を、Ｈ社等に電気工事を、Ｉ社等に左官工事を、Ｊ社に空調、換気及び給排水設備工事を請け負わせ、本件工事の現場管理とこれら２次下請負人等の施工の調整を行った。 当該建設業者が請け負った本件工事は、上記のとおり、とび・土工・コンクリート工事、防水工事、大工工事、内装仕上工事、石工事、タイル・れんが・ブロツク工事、電気工事、左官工事及び管工事から構成される建設工事である。また、株式会社匠屋は、Ｊ社に本件工事における管工事を請け負わせており、本件工事のうち管工事が多くの割合を占めている。 よって、当該建設業者は、本件工事を請け負うためには、少なくとも建築工事業又は管工事業の許可を受けていなければならなかった。しかし、同社は、本件工事において、建設業法第３条第１項の規定に違反して、建築工事業又は管工事業に係る同項の許可を受けないで請負代金が建設業法施行令第１条の２に定める金額以上となる建設工事を請け負った。 また、本件工事においては、当該建設業者が締結した下請契約に係る下請代金の額が、4,000万円（建築一式工事にあっては6,000万円）以上であり、建築工事業又は管工事業に係る特定建設業の許可を受けるべきところ、同社は、建設業法第16条第１号の規定に違反して、同法第３条第１項第２号に掲げる区分による許可を受けないで下請代金の額が同号の政令で定める金額以上となる下請契約を株式会社匠屋と締結した。 さらに、当該建設業者は、建設業法第24条の８第１項に規定する施工体制台帳及び同条第４項に規定する施工体系図を作成しなかった。
