被処分者は、従業者であることを証する証明書を携帯しない者に、被処分者の宅地建物取引業に係る業務を行わせた。 この行為は法第４８条第１項に違反し、法第６５条第１項の指示処分の事由に該当する。 また、被処分者は、被処分者の専任の宅地建物取引士として県に届け出ていた者に、他の宅地建物取引業者の業務を行うことを許すとともに、従業者であることを証する証明書を携帯しない者に被処分者の宅地建物取引業に係る業務を行わせたことにより、法第３１条の３第１項の規定に抵触するに至ったにもかかわらず、二週間以内に、同項の規定に適合させるため必要な措置を執らなかった。 この行為は法第３１条の３第３項に違反し、法第６５条第１項の指示処分の事由に該当する。
