被処分者は、令和４年１２月に、貸主Ａと借主Ｂとの間の建物の賃貸借につき媒介業務を行った。この業務において、①宅地建物取引業法第３５条に定める書面（重要事項説明書）に、宅地建物取引士をして記名させなかった。また、重要事項説明書に、建物の貸借の場合に説明すべき法令に基づく制限の概要の記載、建物状況調査を実施しているかどうかについての記載、借主につき無断不在１ヶ月以上に及ぶ時は本件契約が当然解除となる旨の定め及び反社会的勢力の排除に係る解除の定めについての記載、台所の整備の状況についての記載がない。②同法第３７条第２項に定める書面（賃貸借契約書）に、礼金についての記載がない。③共同媒介業者と共に、Ａ及びＢの双方から、合計で借賃の１月分の２．２倍に相当する、国土交通省告示に定める限度額を超えた金額の報酬を受領した。これらのことは、①は、同法第３５条第１項に、②は、同法第３７条第２項第３号に、③は、同法第４６条第２項に、それぞれ違反する。 ※「都内全域における」業務の全部停止２２日間
