株式会社鈴正工務店は，役員が平成28年11月24日に仙台簡易裁判所から，刑法（明治40年法律第45号）の罪で罰金の略式命令を受け，その刑が確定した。 これにより，建設業法第8条第12号に規定する欠格要件に該当することになったにもかかわらず，平成30年8月29日に解体工事業に係る建設業許可を申請する際及び令和2年10月28日に建設業許可を更新申請する際に，当該欠格要件に該当しないことを誓約する誓約書を提出し，いずれにおいても不正の手段により許可を取得した。 このことは，建設業法第29条第1項第7号に該当する。
