Consequently, Company A directly contracted with the construction company, which then subcontracted to Ise Komuten, collectively undertaking the work. Company A also appointed Ise Komuten as the site supervisor, assigning its own technicians to support the overall construction management. The construction company, under these circumstances, entered into a subcontract with Ise Komuten without the required permit, violating Article 3, Paragraph 1 of the Construction Business Act. 3. The construction company violated Article 22, Paragraph 1 of the Construction Business Act by consolidating the contracted construction work with Ise Komuten and, contrary to Paragraph 2, subcontracted the entire work to Ise Komuten.

１ 当該建設業者は、兵庫県神戸市内の民間発注の工事（以下「本件工事」という。）において、その主なものが防水工事及び塗装工事であるため、防水工事業の許可を受ける必要があるところ、建設業法第３条第１項の規定に違反して防水工事業に係る同項の許可を受けないで請負代金が建設業法施行令第１条の２に定める金額以上となる建設工事をＡ社から請け負った。 ２ 当該建設業者の注文者であるＡ社は、本件工事のうち主たる部分を当初伊瀬工務店に請け負わせる予定であったが、本件工事の着工日直前になって同者が建設業の許可を受けていないことが発覚したため、当該建設業者と直接下請契約を締結し、当該建設業者が伊瀬工務店と下請契約を締結し、これらの工事を一括して請け負った。また、Ａ社は、伊瀬工務店を自社の現場代理人として同者に本件工事全体の施工管理を任し、サポートとして自社の技術者を付けることとしていた。当該建設業者は、このような経緯のもと、本件工事において、建設業法第３条第１項の規定に違反して同項の許可を受けないで建設業を営む伊瀬工務店と下請契約を締結した。 ３ 当該建設業者は、本件工事において、建設業法第22条第１項の規定に違反して、その請け負った建設工事を一括して伊瀬工務店に請け負わせ、同条第２項の規定に違反して、Ａ社から同社の請け負った建設工事を一括して請け負った。
