１ 再下請負通知書の不提出 当該建設業者は、大阪市内の民間発注の工事おいて、その請け負った建設工事を安本組等に請け負わせたにも関わらず、建設業法第24条の８第２項の規定に違反して、発注者から直接その工事を請け負った特定建設業者に対し、再下請負の通知を行わなかった。 ２ 政令で定める金額以上となる下請契約の締結 当該建設業者は、兵庫県尼崎市内の民間発注の工事において、発注者である廣瀬建設株式会社から直接請け負った建設工事（型枠工事）を施工するため、建設業法第16条第１号及び第２号の規定に違反して、同法第３条第１項第２号に掲げる区分による許可を受けないで下請代金の額が同号の政令で定める金額以上となる下請契約を新居組及びA者と締結した。
