新潟県が発注した施設第５号上越警察署(仮称)大潟交番改築工事において、有限会社南波工務店(以下「二次下請負人」とする。)は同工事の二次下請負人である。 二次下請負人は、令和４年10月26日、同工事の安全衛生管理の統括者が、同社の労働者に高さ２m以上の作業床を使用させる際、墜落により労働者に危険を及ぼす恐れがあるところに囲い、手すり、覆い等を設けず、同社の労働者の労働災害を防止するために必要な措置を講じなかった。 このことを原因とし、二次下請負人及び同社安全衛生管理の統括者が労働安全衛生法違反により、高田簡易裁判所から罰金刑を受け、二次下請負人については令和５年３月25日、同社安全衛生管理の統括者については令和５年３月28日に、この刑が確定している。 このことが、建設業法第28条第１項第３号に該当する。
