株式会社大森組の前代表取締役は、その業務に関し、架空の外注加工費等を計上する方法により、３事業年度における同社の法人税及び地方法人税を免れ、また、架空の課税仕入れ額を計上する方法により、３課税期間における同社の消費税及び地方消費税の譲渡割額を免れた。 以上の事実により、令和５年６月30日に東京地方裁判所より、法人税法（昭和40年法律第34号）違反、地方法人税法（平成26年法律第11号）違反、消費税法（昭和63年法律第108号）違反及び地方税法（昭和25年法律第226号）違反で同社は罰金1,600万円、前代表取締役は懲役１年２月、執行猶予３年の判決が下され、令和５年７月14日その刑が確定した。 このことが、建設業法第28条第１項第３号及び同条第３項に該当する。
