延本建設株式会社の元専務取締役は、新発田地域振興局農村整備部発注の「平木田柳原地区取水工第１次工事」に関し、株式会社岩村組の元顧問、株式会社小野組の元役員と共謀の上、当該工事の予定価格の教示を受け、偽計を用いて公の入札で契約を締結するためのものの公正を害すべき行為をしたことにより、令和５年10月11日に公契約関係競売等妨害の容疑で逮捕された。その後、同年11月１日に起訴され、令和６年２月14日に懲役１年（執行猶予３年）の刑が確定している。 このことが、建設業法第28条第１項第３号に該当する。
