西尾組の代表者は、業務に関し、令和3年6月1日、坂出市林田町4035所在の「協和化学工業（株）食堂解体及び準備工事他関連工事（全体）」現場において、労働者Ａらに明り掘削作業を行わせるに当たり、地山の崩壊又は土石の落下により労働者に危険を及ぼすおそれがあったにも関わらず、あらかじめ、労働者の危険を防止するに足る土止め支保工を設ける等の当該危険を防止するための措置を講じず、もって掘削の業務における作業方法から生ずる危険を防止するため必要な措置を講じなかった。 このことから、西尾組の代表者は労働安全衛生法違反により、令和3年9月30日に丸亀簡易裁判所から罰金20万円の略式命令を受け、同年3年10月19日にその刑が確定している。
